TERMS AND CONDITIONS OF SALE
1. PREAMBLE AND APPLICABLE LAW
These Terms and Conditions govern the contractual relationship between Japanzon Co. Ltd (hereinafter "the Seller"), based in Tokyo (Japan), and any person placing an order on the site (hereinafter "the Customer").
By placing an order, the Customer unreservedly accepts the application of Japanese Law. Any dispute regarding the interpretation or execution of these terms shall be under the exclusive jurisdiction of the Tokyo District Court, Japan. The products sold comply with current Japanese legislation.
2. PRODUCTS AND CONDITION (RETROGAMING & USED)
The Seller offers new and used products.
Used Products: The Customer acknowledges that "Vintage" or "Used" products may show signs of wear, scratches, or alterations due to their age. These aesthetic defects cannot be the subject of a claim for non-conformity.
Compatibility: The Customer is solely responsible for checking the compatibility of games and hardware (NTSC-J region coding, 100V voltage, etc.) with their own equipment.
3. PRICES AND TAXES (CUSTOMS)
Prices are displayed in Euros, but the transaction is processed in Japan.
Customs Duties: The Customer is the official importer of the products into their country of residence.
No customs fees are included in the price. Any tax, customs duty, import VAT, or handling fee claimed by the authorities of the destination country is the sole responsibility of the Customer.
4. ORDERS AND CANCELLATIONS
Validating an order implies final acceptance of these Terms.
4.1. Cancellation by the Customer (Excluding Pre-orders) Any request to cancel a standard order (in-stock product) by the Customer before shipment will automatically result in a management and restocking fee of 10% of the total order amount. The refund will therefore be made at 90%. Once the parcel has shipped, no cancellation is possible.
4.2. Pre-orders Pre-orders are firm and final. No cancellation of pre-orders is accepted, except in cases of force majeure or impossibility of supply by the Seller.
5. PAYMENT AND DISPUTES (ZERO TOLERANCE)
Account Closure Clause: The Seller applies a zero-tolerance policy towards fraud and abuse. Any dispute (chargeback, PayPal or bank claim) opened by the Customer without prior contact with Customer Service to attempt an amicable resolution will result in:
Immediate suspension of current orders.
Definitive and irrevocable closure of the customer account.
Banning of the IP address and delivery details for any future orders.
6. DELIVERY AND RETURNED PARCELS (UNDELIVERABLE)
Products are shipped from Japan.
6.1. Management of Returned Parcels (Unclaimed / Undeliverable) A parcel may be returned to the sender for several reasons, including: incomplete or incorrect address, failure to claim within the time limit, refusal of receipt, carrier inability to deliver, or any other logistical reason independent of Japanzon.
Japanzon Error: Only a return due to an error attributable to Japanzon (e.g., address wrongly entered by us on the label) will result in free reshipment.
Customer Error / Unclaimed: For all other cases (wrong customer address, absence during delivery, unclaimed at the post office, unjustified refusal...), reshipping costs will be at the customer's exclusive expense.
Refusal to Reship: In case of refusal to pay reshipping costs, only the amount of the products (excluding initial shipping costs) can be refunded, and this refund will be made solely in the form of store credit valid on Japanzon.com.
Abandoned Parcels: Returned and unclaimed parcels (without customer response) are kept for 10 days before being considered abandoned and destroyed or restocked, without the possibility of a refund or future claim.
7. WITHDRAWAL
In accordance with Japanese law, and given the nature of the products (import), returns for a simple change of mind are not accepted. Returns are only authorized in the event of a manifest error (product not matching the order).
8. PERSONAL DATA PROCESSING
Information collected during your purchases on Japanzon, Rose-Kaori, CookingSan, HitomiGoods, or any other site managed by Japanzon Co. Ltd is subject to personal data processing. It may be used jointly by group entities for order processing, customer service, billing, shipping, as well as for sending commercial offers or newsletters related to our activities. The Customer has a right to access and rectify their data upon request.
